By accessing or using HushHall ("the Platform," "we," "us"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in full, you must not use the Platform. You must be at least 18 years old to create an account.
2. Nature of the Platform
HushHall is an intermediary platform as defined under Section 2(1)(w) of the Information Technology Act, 2000 ("IT Act") and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules"). HushHall does not create, originate, initiate, select, modify, or endorse any user-generated content. All content posted, shared, or transmitted through the Platform is created solely by its users. HushHall is a neutral conduit and is not a publisher of user content.
3. User Responsibility for Content
You are solely and entirely responsible for all content you post, send, upload, or otherwise transmit through the Platform. By submitting content, you represent and warrant that: (a) the content is yours or you have the right to post it; (b) the content does not violate any applicable law or these Terms; (c) you are solely liable for any legal consequences arising from your content. HushHall bears no responsibility whatsoever for any content generated by users. Any legal liability arising out of user content rests exclusively with the user who created it.
4. Prohibited Content
You agree not to post or transmit content that: (a) violates any law in India or the jurisdiction you are in; (b) is defamatory, obscene, pornographic, or paedophilic; (c) threatens national security, public order, or decency; (d) harasses, bullies, or threatens any individual; (e) infringes any patent, trademark, copyright, or other intellectual property right; (f) contains malware, viruses, or harmful code; (g) impersonates any person or entity; (h) promotes hatred based on religion, race, caste, sex, or nationality. Posting such content is a violation of these Terms and may expose you to civil and criminal liability under applicable law. HushHall will cooperate fully with law enforcement agencies in connection with any such content.
5. Intermediary Safe Harbour
HushHall claims safe harbour protection under Section 79 of the IT Act. We are not liable for any third-party content hosted on the Platform provided we: (a) do not initiate the transmission; (b) do not select the receiver; (c) do not select or modify the information. This protection applies to the fullest extent permitted by law. Any action to hold HushHall liable for user-generated content is expressly disclaimed.
6. Indemnification
You agree to fully indemnify, defend, and hold harmless HushHall, its operators, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to: (a) your use of the Platform; (b) your content; (c) your violation of these Terms; (d) your violation of any law or third-party rights. This indemnity obligation will survive termination of your account.
7. Anonymous Use
HushHall is architected from the ground up to protect user anonymity. Anonymous posts carry no identifying information visible to any party — including HushHall staff. We have no surveillance infrastructure, no content monitoring systems, and no capability to proactively identify users. The Platform operates on a strict report-and-review model: content enters any moderation process only when explicitly reported by another user, and even then, only the reported content is examined — nothing else. Identity can only be disclosed pursuant to a binding order from a competent court of law or a lawful directive from a government authority with jurisdiction. No voluntary disclosure occurs under any other circumstance, for any reason. By design, we cannot give what we do not access.
8. Message Expiry
All hall messages and direct messages are permanently and automatically deleted after 24 hours. HushHall is not liable for any loss arising from this automatic deletion. You must not rely on the Platform for permanent storage of any communication.
9. Content Takedown & Support
HushHall respects the rights of all users and third parties. If you believe content on the Platform is unlawful, defamatory, or in violation of these Terms, you may submit a written complaint to our Support Team at support@hushhall.com. Complaints must include: (a) your full name and contact details; (b) a clear description of the content in question and its location on the Platform; (c) the nature of the violation and the relief sought. We will acknowledge receipt within 24 hours and endeavour to resolve the complaint within 15 days, in compliance with the IT Rules, 2021. HushHall reserves the right to remove any content at its sole discretion, without prior notice and without any liability whatsoever. Submission of a false or malicious complaint may itself constitute a violation of these Terms.
10. Account Suspension & Termination
We reserve the right to suspend or permanently terminate any account, at our sole discretion and without prior notice, if we reasonably believe the account has been used in violation of these Terms or applicable law. Termination does not limit any other rights or remedies available to HushHall.
11. Content Ownership & Licence
You retain ownership of content you post. By posting, you grant HushHall a non-exclusive, royalty-free, worldwide licence to store and display that content solely to operate the service. This licence terminates when the content expires or your account is deleted.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUSHHALL AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED INR 1,000.
14. Push Notifications
By enabling push notifications, you consent to receive activity alerts from halls you have joined. You may disable this at any time via Settings. We will not send promotional or marketing notifications.
15. Governing Law & Jurisdiction
These Terms are governed exclusively by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of competent courts in India. You waive any objection to such jurisdiction.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force.
17. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.
